Terms of use — Lapin

Article 1 — Purpose

Lapin is a mobile run/walk interval training app for beginners, published by Ternaire inc. (Brossard, Québec, Canada). It offers personalised training programmes generated by artificial intelligence, a conversational coach, session tracking (Android phone and Wear OS watch) and progress statistics. These terms form a contract between you and Ternaire inc.: by creating an account or using Lapin, you accept them. If you do not agree, do not use Lapin.

Article 2 — Account

Using Lapin requires an account, created by signing in with a Google account (authentication operated by Firebase; Apple sign-in will come with the iOS app). You are responsible for access to your sign-in account and for what is done with it. An account is personal: it can be neither shared nor transferred. If you think someone else is accessing it, write to us without delay.

Article 3 — Minimum age

Lapin is reserved for people aged 14 and over. By creating an account, you declare that you are at least 14. If the law of your country requires a higher age to consent on your own to an online service, you declare that you are that age, or that you have the consent of a parent or guardian. If we learn that an account does not follow this rule, it is deleted, along with the associated data.

Article 4 — Subscription and free trial

• Lapin works by subscription, taken out and billed through Google Play. Lapin never sees your card or your bank details.
• Your first programme is generated before any subscription: you see your proposal before we mention a trial.
• Every new subscription starts with a 7-day free trial, once per Google account. If you cancel before the end of the trial, nothing is charged; otherwise, the paid subscription starts automatically when the trial ends.
• The price, taxes and currency are shown in the app and on the Google Play sheet before any purchase; the Google Play sheet is authoritative. A price change is announced to you in advance by Google Play, under its rules, before it applies to your renewal.
• The subscription renews automatically until cancelled. Cancelling happens in the Play Store (Manage subscriptions), not in the app; it takes effect at the end of the period already paid, which you keep to the end.
• Refunds follow Google Play's rules and the rights the law of your country of residence gives you.

Article 5 — End of subscription: read-only mode

When the subscription ends, your account is not deleted: your history, your statistics and your records remain viewable (read-only). The active functions — programme generation, sessions, coach — lock until a subscription resumes.

Article 6 — Acceptable use

You agree to:

• use Lapin for your own training, in a private, non-commercial setting;
• not attempt to bypass the subscription, to access Lapin's systems other than through the app, or to disrupt how it works;
• not use the conversational coach for purposes foreign to the service (model extraction, unlawful content, harassment, spam);
• not resell, decompile or redistribute the app or its content.

Ternaire inc. may suspend or close an account in case of a serious or repeated breach, after informing you when reasonably possible. You, for your part, may end the contract at any time by deleting your account (article 12).

Article 7 — Health warning

Lapin is not a medical service. Lapin's coach is an artificial intelligence: it is not a health professional and provides no diagnosis, medical advice or treatment. The programmes, messages and data displayed (including heart rate and estimated zones) are provided for information, for training purposes.

Consult a doctor before starting an exercise programme, especially if you have a medical condition, if you feel pain, dizziness or unusual shortness of breath, or if you are returning to physical activity after a long break. If you feel unwell during a session, stop and seek advice. Lapin is not an emergency service: in an emergency, call your country's emergency services.

Article 8 — The coach and content generated by artificial intelligence

The programmes, adjustments, suggested sessions and coach messages are produced by an artificial intelligence model from your answers and the summary of your sessions. Ternaire inc. checks their structure and progression mechanically, but cannot guarantee that they are always accurate or suited to your situation: they may contain errors. You keep control: nothing applies without your action, you can lighten, decline or stop a programme at any time, and you can write to us to have a person review a proposal. Lapin promises no result.

Article 9 — Intellectual property

The app, its brand, its texts, its visuals, its sounds and its code remain the property of Ternaire inc. or its licensors. Your subscription gives you a personal, non-exclusive, non-transferable and revocable right of use, for the duration of the subscription, for private use. The programmes generated for you remain available to you for your personal use. Your own data (sessions, tracks, answers, messages) remains yours: you only authorise us to process it to provide you the service, as the privacy policy describes, and the policy says how to export it.

Article 10 — Availability and evolution of the service

Lapin is provided as is, with possible interruptions (maintenance, outage, network, providers). Programme generation and the coach require a connection; the session itself works offline. Ternaire inc. may change, add or remove functions. Should Ternaire inc. end Lapin, you would receive reasonable notice, by email or in the app, with time to export your data; no subscription would be renewed.

Article 11 — Limitation of liability

You run and walk at your own risk. To the extent permitted by applicable law, Ternaire inc. is not liable for injuries, damage or losses related to sport, to the unavailability of the service, to the loss of data that lives only on your device, to the inaccuracy of sensors (GPS, heart rate) or to the inherent limits of an artificial intelligence system; to the same extent, its total liability is limited to the amounts you paid for Lapin in the twelve months before the event. Nothing in these terms excludes or limits a liability that cannot be excluded or limited under the law that protects you as a consumer (in Québec, the Consumer Protection Act), nor liability for intentional or gross fault.

Article 12 — Account deletion and inactive accounts

You can request the deletion of your account in the app (“My data”). The request requires re-authentication and a confirmation by email; it opens a 30-day grace period during which signing back in cancels the request. After that period, all your server data is erased (policy, section 9). An account with no sign-in for 24 months is deleted the same way: you receive a warning email 30 days before, and signing back in is enough to keep it. Note: deleting your account does not cancel your subscription — that is managed and cancelled in the Play Store.

Article 13 — Changes to the terms

Ternaire inc. may change these terms; any substantial change is announced in the app before it takes effect, with the version and date of the text. Continuing to use Lapin after it takes effect counts as acceptance; if you refuse, you can delete your account. A price change follows article 4.

Article 14 — Governing law and disputes

These terms are governed by the laws of the province of Québec and the laws of Canada that apply there. If you live elsewhere, the mandatory consumer protection rules of your country also apply, and they prevail over the above. Any dispute falls under the competent courts of Québec, unless the law of your country of residence gives you the right to bring it before your own courts. Before any legal action, write to us: most disputes are settled by email.
